Migrant Protection Protocols (MPP)

On January 25, 2019, Secretary Nielsen issued a memorandum entitled Policy Guidance for Implementation of the Migrant Protection Protocols, in which she provided guidance for the implementation of the Migrant Protection Protocols (MPP) announced on December 20, 2018, an arrangement between the United States and Mexico to address the migration crisis along our southern border. Pursuant to the Secretary's direction, this memorandum provides guidance to U.S. Immigration and Customs Enforcement (ICE) about its role in the implementation of the MPP.

This memorandum provides operational guidance to impacted Enforcement and Removal Operations (ERO) field offices to ensure that the Migrant Protection Protocols (MPP) are implemented in accordance with applicable law, the Secretary's January 25, 2019, memorandum, Policy Guidance for Implementation of the Migrant Protection Protocols, Acting Director Vitiello's February 12, 2019, memorandum of the same title, and other applicable policies and procedures.

Enforcement and Removal

287(g)

Allows a state and local law enforcement entity to enter into a partnership with ICE, under a joint MOA to receive delegated authority.

In 2009, ICE revised the 287(g) delegated authority program.

Detention Oversight

ERO opened the Berks Family Residential Center to accommodate noncitizen families in ICE custody.

Enforcement and Removal Operations

Data captured from July 13 to Aug. 20, 2020, shows that ICE officers arrested more than 2,000 at-large individuals living illegally in the U.S.

IAO is ICE’s primary air transportation division. ICE continuously revises its detention standards as needed.

ODLS allows family members, legal representatives, and members of the public to locate individuals who are detained by ICE.

Noncitizens who arrive in the US at a POE and are found to have a credible fear of persecution or torture will automatically be considered for parole.

This policy is part of DHS’s effort to avoid restricting people’s access to essential services or engagement in essential activities.
